Supreme Court of Delaware
Richards v. Copes-Vulcan, Inc.
July 22, 2019
Summary
The court held that Ohio's asbestos-causation statute does not eliminate the general requirement for expert medical evidence establishing specific causation. Evidence concerning the manner, proximity, frequency, and length of exposure satisfies only the exposure component of the analysis and does not itself link each defendant's asbestos exposure to the plaintiff's mesothelioma. The court also held that the Superior Court did not abuse its discretion by denying reargument and a request to supplement the expert report after summary judgment had been entered.
