Supreme Court of Delaware
Matter of JaneTyler
April 17, 2019
Summary
The Supreme Court of Delaware affirmed the Court of Chancery’s orders keeping a Guardianship Monitoring Program report under seal. It held that Court of Chancery Rule 180-D provided an adequate basis for confidentiality and that the guardians’ asserted due-process interests did not outweigh the State’s compelling interest in protecting information concerning alleged abuse of a dependent adult. The Court also rejected the claim that the Vice Chancellor overruled the exceptions without meaningful review. No separate opinions were filed.
