Supreme Court of Delaware

Kostyshyn v. State

November 13, 2019

Summary

The Supreme Court of Delaware affirmed Patricia Kostyshyn’s conviction for criminal mischief. Although the admission of the investigating officer’s opinion about her intent was debatable and the issue was raised for the first time on appeal, any error was harmless because the remaining evidence was sufficient to establish intentional conduct beyond a reasonable doubt. The Court therefore found no plain error requiring reversal.
