Supreme Court of Delaware

Jones v. State

May 13, 2019

Summary

The Supreme Court of Delaware affirmed the Superior Court's summary dismissal of Jones's third motion for postconviction relief. It held that Jones could not raise ineffective-assistance claims against postconviction counsel in a later postconviction proceeding and had not satisfied the exceptions for newly discovered evidence or a retroactively applicable constitutional rule. Because the motion was procedurally barred, the Superior Court also acted within its discretion in denying appointed counsel.
