Summary

The Supreme Court of Delaware affirmed the denial of Johnson’s first motion for postconviction relief. It held that Johnson failed to establish ineffective assistance of counsel because counsel investigated the case, litigated suppression, and Johnson did not show that different performance would have caused him to reject the favorable plea agreement. The court also held that Johnson’s independent challenges to the search and seizure and alleged disclosure violation were procedurally barred and waived by his knowing, voluntary guilty plea.
