Summary

The Court affirmed the denial of Gatewood’s motion to modify his sentence. Although the Superior Court incorrectly treated the motion as untimely, the denial was proper because the motion was repetitive, and the court had adequately addressed Gatewood’s request by leaving the form of Level IV confinement to the Department of Correction. The Court also concluded that no modified sentencing order was necessary because the DOC’s status sheet accurately reflected that discretion.
