Supreme Court of Delaware
Garrett v. DFS
June 17, 2019
Summary
The Court affirmed the Family Court’s termination of the Mother’s parental rights to her two daughters. It held that the Family Court properly found, by clear and convincing evidence, both a statutory ground for termination and that termination was in the Children’s best interests, and that the factual findings were supported by the record. The Court found no legal error or abuse of discretion in concluding that the Mother could not yet assume custody after the Children had remained in foster care for more than two years.
