Summary
The Court affirmed the denial of Duffy’s first postconviction motion after concluding that his non-ineffective-assistance claims were procedurally barred or waived by his knowing and voluntary guilty plea. It also held that Duffy failed to establish ineffective assistance, actual innocence based on newly discovered evidence, or entitlement to appointed postconviction counsel. The plea agreement substantially reduced Duffy’s exposure by dismissing charges and limiting the State’s sentencing recommendation. No separate opinions were filed.
