Supreme Court of Delaware
Cohen v. Dscyf/dfs
September 23, 2019
Summary
The Supreme Court of Delaware affirmed the Family Court’s denial of the maternal grandmother’s petitions for guardianship of five grandchildren. The Family Court properly applied the statutory dependency and best-interests framework and reasonably concluded that the relevant best-interests factors weighed against granting guardianship. The Supreme Court also rejected the grandmother’s claim that the Family Court judge had a conflict of interest because the alleged conflict was unsupported by the record and the challenged testimony was not relied upon.
