Summary
The court held that the release executed in settling the claims against the surgeon completely satisfied the plaintiff's remaining vicarious-liability claim against the hospital. Because the release reduced claims against unreleased entities by the released tortfeasor's entire pro rata responsibility, and the surgeon's responsibility represented the full amount of damages attributable to the alleged negligence, the hospital was entitled to partial summary judgment. The court therefore reversed the Superior Court's denial of that motion.
