Supreme Court of Delaware
Borne v. Reynold
August 27, 2019
Summary
The Supreme Court affirmed the Family Court’s order resolving the parties’ military-pension claims, offsetting the arrearage owed to Borne against his outstanding judgment debt to Reynold, and awarding Reynold attorney’s fees. The court held that Borne waived his statutory and procedural objections to the offset, and in any event the offset was within the Family Court’s equitable discretion. It also upheld the pension calculations and attorney-fee award because the record supported the Family Court’s findings and its conclusion that Borne pursued frivolous and unnecessarily prolonged litigation.
