Supreme Court of Delaware
Beamer v. DFS
July 10, 2019
Summary
The Court affirmed the termination of the Mother's parental rights because clear and convincing evidence supported the statutory ground that she failed to plan adequately for the Child's needs, DFS made reasonable reunification efforts, and termination served the Child's best interests. Although the Family Court misapplied the factor concerning the Mother's wishes, that error did not affect the overall best-interests determination because the remaining factors supported termination. The Court also concluded that the appeal was wholly without merit and that counsel properly sought withdrawal.
