Summary

The Supreme Court of Delaware affirmed the denial of Bacon’s third motion for postconviction relief. It held that the federal appellate decision invoked by Bacon did not create a new retroactive constitutional rule, and therefore could not excuse the procedural bars applicable under Rule 61.
