Supreme Court of Delaware

Winn v. State

May 29, 2018

Summary

The Court held that Winn’s habitual-offender sentence for a 2006 burglary was properly designated as a Truth in Sentencing Act sentence because the Act applies to crimes committed after June 29, 1990. Although the Court rejected Winn’s claim to pre-Act good-time rates, it accepted the State’s concession that he was entitled to good-time credit under the Act. The Superior Court’s denial of correction of sentence was therefore affirmed in part.
