Summary

The Supreme Court of Delaware affirmed the Superior Court’s finding that Martin Thompson violated probation for a third time and its resulting sentence. The court held that a probation violation may be based on new criminal conduct even when the resulting charges are later dismissed, and that Thompson’s undisputed failure to report independently supported the violation finding. It also concluded that the VOP sentence was neither arbitrary nor excessive because it was less than the remaining Level V imprisonment authorized by law.
