Supreme Court of Delaware

Shorts v. State

May 30, 2018

Summary

The Court affirmed the denial of Shorts's motion to withdraw his guilty plea. Although the plea colloquy did not state the statutory sentencing range and the plea form misstated the possible maximum while an habitual-offender petition was pending, the State's withdrawal of that petition made the sentencing range conform to the plea form and eliminated any manifest injustice. The Court also upheld the finding that Shorts's plea was knowing and voluntary because his sworn colloquy responses contradicted his later claim of coercion.
