Summary

The Court affirmed Roy’s convictions, holding that the Superior Court did not abuse its discretion by admitting the victim’s statement to police as an excited utterance. The victim’s calm behavior during the attempted robbery did not contradict the officer’s testimony that the victim remained scared and in shock during the police interviews, and the statement therefore was made while the event’s stress continued.
