Summary

The Supreme Court of Delaware affirmed the summary dismissal of Hester’s second motion for postconviction relief. It held that a 2013 amendment providing counsel for an indigent movant’s first postconviction motion was not a new, retroactively applicable rule of constitutional law and therefore did not satisfy the exception to the successive-motion bar. The court also declined to consider new grounds raised for the first time on appeal.
