The Supreme Court of Delaware denied the State’s motion for rehearing en banc of its earlier decision reversing the Superior Court’s denial of Harden’s post-conviction motion. The Court rejected the State’s contention that Harden could not show a reasonable probability that adequate sentencing preparation would have resulted in the 15-year sentence advocated by the State, rather than the 18-year sentence imposed.
