Summary

The Court affirmed the Superior Court's dismissal without prejudice of Day's repetitive claims arising from two Florida automobile accidents. It held that comity permitted Delaware's Superior Court to require Day to comply with filing restrictions and monetary sanctions imposed by federal courts before pursuing substantially similar claims in Delaware. The dismissal did not foreclose refiling upon proof that the sanctions had been paid.
