Supreme Court of Delaware

Boone v. State

October 9, 2018

Summary

The Court affirmed the denial of Boone’s motion to correct his probation-violation sentence. It held that the motion could address only an illegal sentence, not alleged errors at the violation hearing, and that Boone’s sentence was authorized because it did not exceed the remaining Level V time from his original sentence. The Court also rejected Boone’s claim that exceeding nonbinding sentencing guidelines demonstrated judicial bias or a closed mind.
