Summary

The Supreme Court of Delaware affirmed the denial of Benson’s motion to correct his sentence as illegal. Although the motion was not time-barred, Benson’s agreed habitual-offender status was supported by his prior violent-felony convictions, including carrying a concealed deadly weapon, and his fifteen-year sentence for possession of a firearm by a person prohibited did not exceed the applicable statutory maximum. The court also found no merit in Benson’s claim concerning transcripts at State expense.
