Summary
The Supreme Court of Delaware affirmed summary judgment for all five defendants in a take-home asbestos exposure action. For four defendants, the plaintiffs lacked evidence allowing a jury to reasonably infer that Barbara Reed’s father or former husband was in specific proximity to the relevant products when they were used. Bayer separately raised friability, but the plaintiffs likewise lacked non-speculative evidence placing Barbara Reed’s father near Bayer-distributed products while they were friable.
