Supreme Court of Delaware
Randolph v. State of Delaware Board of Parole
February 6, 2017
Summary
The Court affirmed the dismissal of Randolph’s mandamus petition because he had no clear legal right to reinstatement of parole or monetary damages, and the Board’s decision to revoke parole was discretionary. It also held that dismissal of the underlying criminal charges did not necessarily prevent the Board from revoking parole based on the alleged new offense. Because Randolph raised potentially significant due process concerns, the Court remanded without prejudice for appointment of counsel and possible amendment of the complaint.
