Supreme Court of Delaware
Hughes-Warren v. State
June 8, 2017
Summary
The Court held that Hughes-Warren's challenges to the violation-of-probation finding and the reasons for his sentence could not be reviewed because he failed to provide the transcript of the relevant hearing. It also held that, after a violation of probation, the Superior Court could impose incarceration up to the remaining Level V balance, but remanded for determination of whether Hughes-Warren was entitled to credit for time previously served at the Level IV VOP Center. The judgment was affirmed in all other respects.
