Summary

The Supreme Court of Delaware affirmed the denial of Flonnory’s motion challenging his mandatory non-parolable life sentences under Rule 35(a). It held that Rule 35(a) permits correction only of an illegal sentence and that Flonnory, who was eighteen when he committed the murders, had not shown that juvenile sentencing standards applied to him. The Court therefore found no reversible error in the Superior Court’s denial of relief.
