Supreme Court of Delaware

Faulkner v. State

December 4, 2017

Summary

The Court affirmed the denial of Faulkner’s petition to expunge his juvenile criminal history. It declined to apply a statutory amendment enacted after the Family Court’s decision and held that Faulkner’s two 2006 incidents constituted two separate cases because they involved separate complaints, victims, and dates. The Court also held that the statutory definition of “case” was unambiguous and required application of its literal meaning.
