Supreme Court of Delaware

Delphi Petroleum, Inc. v. Magellan Terminal Holdings, L.P.

December 12, 2017

Summary

The court held that prejudgment interest on fuel-heating overcharges should run from the dates Delphi paid the overcharges, rather than from a later payment date, and remanded for recalculation. It also reversed the finding that Magellan committed fraud because its email accepting revised contract language was not a false representation, and Magellan had no duty in the arm's-length transaction to correct Delphi's misunderstanding of an unambiguous agreement. All other rulings were affirmed.
