Supreme Court of Delaware

Bliss v. State

April 5, 2017

Summary

The Court affirmed the denial of Bliss’s motion to correct his sentence. Although the Superior Court treated his claim as one that had to be raised under Rule 61, the Supreme Court held that the claim alleged a sentence imposed in an illegal manner and was therefore subject to Rule 35’s ninety-day limitation, absent extraordinary circumstances or a Department of Correction application. Bliss established neither exception. The opinion contains no separate writings.
