Supreme Court of Delaware

Bennett v. Usaa Casualty Insurance Co.

March 13, 2017

Summary

The Court affirmed judgment for USAA, holding that the Bennetts failed to present legally sufficient evidence that USAA denied coverage without reasonable justification. Although the Superior Court incorrectly concluded that the Bennetts were required to call a USAA representative to explain the denial, the directed verdict was proper because the Bennetts presented no evidence supporting bad faith. The Court also upheld the instruction informing the jury that the bad faith claim was no longer in the case.
