Summary
The Court affirmed the summary dismissal of Wilmer’s ninth motion for postconviction relief because he did not satisfy the requirements governing successive motions under Rule 61(d)(2). Wilmer neither pleaded particularized new evidence creating a strong inference of actual innocence nor identified a retroactive new constitutional rule invalidating his conviction. The Court also found that his fifteen-year pattern of repetitive and unsupported filings abused the judicial process and enjoined further filings concerning his conviction and sentence absent leave of court.
