Supreme Court of Delaware

Thompson v. State

August 19, 2016

Summary

The Supreme Court of Delaware affirmed Thompson’s sentence for his third violation of probation. It held that his counseled admission that he consumed alcohol in violation of probation supplied sufficient evidence of the violation and waived his Rule 32.1 due-process and Fourth Amendment claims. The Court also concluded that the sentence was within statutory limits and found no support for Thompson’s claims of false testimony, vindictiveness, or a closed judicial mind.
