Supreme Court of Delaware
Miller-Howard v. Mason
July 21, 2016
Summary
The Supreme Court of Delaware reversed the Family Court’s denial of Father’s petition for sole custody and remanded for entry of an order granting Father full custody. The Court held that the Family Court improperly relied on the general equal-parent language governing parental rights despite undisputed evidence that every applicable best-interest factor favored Father. The Court also ordered that Mother’s visitation remain limited to the schedule established in the interim order.
