Supreme Court of Delaware
Lewis v. State
June 16, 2016
Summary
The Court affirmed Lewis's convictions, holding that the Superior Court did not commit plain error by considering aggravated menacing as a lesser-included offense of first-degree robbery. Although the trial court initiated the discussion during closing arguments, the State affirmatively requested consideration of the lesser-included offense and the defense agreed without objecting. The Court also concluded that the absence of a pre-closing conference did not require reversal under these circumstances.
