Summary

The Supreme Court of Delaware affirmed the denial of Lewis’s motion to correct his sentence. Although the Superior Court mistakenly treated the motion as one for sentence modification and incorrectly found it time-barred, the Supreme Court held that the motion properly failed on the merits because Lewis’s habitual-offender sentence was authorized by statute. The Court concluded that the habitual-offender statute did not require all predicate felony convictions to be violent felonies.
