Supreme Court of Delaware
Kathryn Mennen, Sarah Mennen, Alexandra Mennen, Shawn Mennen, and John Mennen, Plaintiffs…
October 11, 20162016 Del. LEXIS 534
Summary
The Supreme Court held that the Court of Chancery improperly treated the Beneficiaries’ exceptions to a Master’s spendthrift ruling as subject to the three-day deadline for expedited proceedings. It also held that the Court of Chancery should have addressed the Beneficiaries’ arguments that any untimeliness resulted from excusable neglect, including reliance on court personnel. The matter was remanded for consideration of the merits of the exceptions, with jurisdiction retained over the remaining appellate issues.
