Supreme Court of Delaware

Gunter v. State

May 9, 2016

Summary

The Court independently reviewed the record under the no-merit appeal procedure and affirmed Gunter’s convictions and sentence. It held that the Superior Court did not abuse its discretion by denying Gunter’s late requests for new counsel because he was offered the choice of proceeding with existing counsel or proceeding pro se, and he chose existing counsel. The Court also held that Gunter’s claims concerning trial strategy and the chain-of-custody stipulation were ineffective-assistance claims not reviewable for the first time on direct appeal.
