Croll v. State

Summary

The Supreme Court of Delaware affirmed the denial of Croll's habeas corpus petition. Although Croll claimed that separate sentences for aggravated menacing and possession of a deadly weapon during the commission of a felony violated double jeopardy, the court held that an illegal-sentence claim could not be reviewed through habeas corpus because the sentencing court had jurisdiction and authority to impose the sentence.
