Supreme Court of Delaware

Coleman v. State

February 5, 2016

Summary

The Court affirmed the denial of Coleman’s motion to correct his sentence. Although the Superior Court incorrectly treated the motion as one for sentence modification and applied timeliness and repetitiveness restrictions, the motion properly failed under Rule 35(a) because Coleman’s habitual-offender sentence was legally authorized. The Court held that the habitual-offender statute does not require predicate felonies to be classified as violent felonies.
