Supreme Court of Delaware

Cohee v. State

November 14, 2016

Summary

The Court affirmed the denial of Cohee’s motion to correct his sentence. It held that a sentence-correction motion is limited to correcting an illegal sentence and cannot be used to challenge the underlying probation-violation adjudication or alleged errors at the violation hearing. The VOP sentence was authorized because it reimposed remaining Level V time and suspended it on treatment-related conditions.
