Supreme Court of Delaware

Aikens v. State

August 29, 2016

Summary

The Court affirmed Aikens's convictions after independently reviewing the record under the applicable withdrawal-and-brief procedure and finding no arguably appealable issue. It rejected his challenges concerning hearsay, evidence preservation, the vehicle stop and search, marijuana testimony, Miranda warnings, jury-trial waiver, an alleged unrecorded sidebar, and sufficiency of the evidence. The Court concluded that several claims were waived or subject only to plain-error review and that the record otherwise supported the convictions.
