Supreme Court of Delaware

Small v. State

January 5, 2015

Summary

The Court affirmed Small's conviction for possession of a firearm by a person prohibited after independently reviewing the record under the withdrawal procedure. It held that Small's ineffective-assistance claim was not reviewable on direct appeal, his suppression motions were untimely and presented no exceptional circumstances, and his remaining evidentiary and selective-prosecution claims lacked merit. The Court concluded that the appeal was wholly without merit and contained no arguably appealable issue.
