Summary

The Supreme Court of Delaware affirmed the Superior Court’s summary dismissal of Lakisha Short’s second motion for postconviction relief. The court held that Short lacked standing under Rule 61 because she was no longer in custody for, or serving the sentence imposed in, the burglary case, notwithstanding her contention that the burglary conviction was used to enhance a later sentence.
