Supreme Court of Delaware

Rhodes v. State

July 21, 2015

Summary

The Supreme Court of Delaware affirmed the denial of Rhodes’s first motion for postconviction relief. It held that his knowing, intelligent, and voluntary guilty plea waived any challenge based on newly discovered OCME misconduct because the evidence would have served only to impeach the State’s trial evidence. The Court also declined to consider a due process challenge to a 2014 amendment because Rhodes had not raised it below.
