Summary

The Court affirmed the summary dismissal of Paskins’s first postconviction-relief motion as untimely under Rule 61(i)(1). Paskins’s challenge to the reliability of the alcohol test and his attempt to recast his admission did not establish either an actual-innocence exception or a retroactively applicable new constitutional rule. The Court therefore held that the Superior Court properly dismissed the motion.
