Supreme Court of Delaware

Newton v. State

July 15, 2015

Summary

The Court affirmed the denial of Newton’s untimely motion for postconviction relief. It held that a codefendant’s guilty plea did not trigger double-jeopardy or collateral-estoppel protections barring Newton’s later guilty plea, and that Newton therefore failed to establish either a jurisdictional claim or a colorable constitutional violation. The ineffective-assistance and robbery-sentence claims likewise failed because they rested on the same meritless premise.
