Summary

The Court affirmed the denial of Morris’s motion to correct his sentence. It held that the motion was untimely under Rule 35(a) and that, in any event, the sentences imposed after retrial were not increased because the additional term resulted from separate violation-of-probation convictions. The Court therefore rejected Morris’s due process claim of a vindictive sentence.
