Knox v. State

Summary

The Court affirmed the denial of Knox’s motion to correct his second violation-of-probation sentence. It held that most of Knox’s claims attacked the underlying violation finding or pre-sentence proceedings and therefore were outside the scope of a sentence-correction motion; his sole cognizable claim was unpreserved, and although the sentence exceeded the remaining suspended Level V time, the error caused no prejudice because the sentence was immediately suspended and no longer in effect. The Court therefore deemed the challenge moot and affirmed on different grounds.
