Kanda v. State

Summary

The Supreme Court of Delaware affirmed the denial of Kanda's first motion for postconviction relief. It held that his warrantless-search claim was formerly adjudicated, his illegal-detention claim was procedurally barred without cause, prejudice, or a miscarriage-of-justice exception, and his ineffective-assistance claim failed because the apartment had been searched pursuant to a warrant obtained before the search. The Court also concluded that the appeal was wholly without merit and that appointed postconviction counsel had conscientiously reviewed the record.
