Supreme Court of Delaware
Fletcher v. State
February 24, 2015
Summary
The Supreme Court of Delaware affirmed the denial of Fletcher’s motion to correct an illegal sentence. Although the Superior Court mistakenly treated the motion as one for sentence reduction, the Supreme Court held that the motion lacked merit under Rule 35(a) because that rule cannot be used to challenge the legality of convictions and the challenged sentences were lawful. The court further held that separate felonies may support separate firearm-possession sentences even when only one firearm was involved.
